When Vaginal Mesh Treatment Becomes Negligent
Clinical negligence often centres on failures before, during, or after surgery. This may include patients not being properly warned about risks, not being offered safer or less invasive alternatives first, or complications being missed or poorly managed. Claims often focus on whether informed consent was obtained, whether the procedure was clinically appropriate, and whether emerging symptoms were acted on promptly.
Types of Vaginal Mesh Procedures
Different mesh procedures carry different risks, and the type of implant used is often central to a compensation claim.
Common mesh procedures include:
- TVT (Tension-Free Vaginal Tape): placed under the urethra to support bladder control
- TVT-O / TOT: inserted through the groin, linked to higher rates of chronic groin and leg pain
- Transvaginal Mesh (TVM): used to treat pelvic organ prolapse and later restricted due to safety concerns
Claims frequently arise where patients were not told that some procedures had limited supporting evidence, higher complication rates, or where national guidance later changed. Many women report they would not have agreed to surgery had they been fully informed of the risks or offered alternatives such as physiotherapy or non-mesh procedures.
We will cover the costs unless we win your case.

Am I Eligible to Make a Claim?
To bring a successful claim, four key elements must usually be proven:
1
Duty of care
The healthcare provider had a legal responsibility to care for you.
2
Breach of duty
The care fell below acceptable medical standards.
3
Causation
The harm you suffered was a direct result of that substandard care.
4
Damage
You experienced physical, emotional, or financial harm as a consequence.
Is there a time limit?
You usually have three years from the date of the incident or when you first realised negligence may have occurred. Exceptions may apply for children or those lacking mental capacity.

Your Questions Answered
My symptoms appeared years later – does that matter?
No. Complications linked to vaginal mesh can develop gradually and may not become obvious for several years. The time limit for bringing a claim (typically 3 years) usually starts from when you first became aware that your symptoms may be linked to the mesh, not from the date of the original surgery.
What kinds of complications are relevant to a claim?
Claims commonly involve complications such as:
- Persistent pelvic, groin, or abdominal pain
- Mesh erosion or exposure
- Bladder or bowel injury
- Nerve damage affecting mobility or sensation
- Sexual dysfunction or pain during intercourse
- Recurrent infections or bleeding
You do not need to experience every complication for a claim to be valid.
What if my concerns were dismissed or not investigated properly?
Many women report repeated appointments where symptoms were minimised, misattributed, or not fully investigated. A failure to recognise mesh-related complications or delay referral to specialists can be relevant when assessing whether care fell below acceptable standards.
Can I make a claim on behalf of someone else?
Yes – if the person affected is unable to bring the claim themselves, a litigation friend can act on their behalf. This applies if the individual:
- Is under 18
- Has limited or no mental capacity
- Has experienced cognitive decline or disability that prevents legal decision-making
Litigation friends are often family members or close friends. They make legal decisions in the claimant’s best interest and liaise with the solicitor to progress the case.
How is compensation calculated in vaginal mesh claims?
Compensation reflects both the harm caused by the mesh implant and the wider impact it has had on your life. Awards are usually divided into two parts:
- General damages cover the physical and psychological effects of mesh-related injury, such as chronic pelvic pain, nerve damage, mobility problems, sexual dysfunction, and the distress caused by long-term or irreversible complications.
- Special damages account for financial losses linked to the injury, including corrective or removal surgery, ongoing medical treatment, pain management, therapy, loss of earnings, reduced ability to work, travel costs, and any future care or support needs.
Every vaginal mesh claim is assessed individually, with compensation intended to support recovery, ongoing treatment, and long-term quality of life where mesh complications cannot be fully resolved.
